It is required for civil servants to resign from their duties in order to be candidates in elections for members of parliament. This stipulation is included both in the Constitution and in the Law for the Election of Members of Parliament. As a Constitutional absolute necessity, it is possible for those who resign from their duties to return to their duties in case they do not become candidates or they are not elected as members of parliament. This right, together with exceptions, is included in the Law on the Basic Decrees of Elections. It has been forbidden for some civil servants to return to their duties. Returning to their duties has been made absolutely necessary in case former civil servants do not become a candidate or they are not elected; it is not under the discretion of the administration where they worked. However, returning to duties after performing these duties has been regulated diff erently in the related law from the aspect of each employee.
