Üst düzey kamu görevlilerinin atanmasında devlet başkanına tanınan takdir yetkisinin kamu menfaatlerine aykırı kullanılması söz konusu olabilmektedir. Atanacak kişilerin sahip olması gereken niteliklerin tespit edilmesi, üst düzey kamu görevlisi atamalarında devlet başkanına tanınan takdir yetkisinin istismar edilmesinin önüne geçebilecektir. Bu çalışmada İslam kamu hukukuna dair eserler ve siyasetnameler çerçevesinde üst düzey kamu görevlilerinde bulunması gereken özelliklerin tespitine çalışılarak mezkûr sorunun çözümüne katkı sunmak hedeflenmiştir. İlgili özelliklerin tespiti yapılırken devletlerin çöküş sebeplerini ve bunların çözümü için gerekli ıslahatı konu edinen siyasetnameler, çalışmada önemli bir yer tutmuştur. Siyasetnamelerin yanında İslam kamu hukukuna dair eserler ve tefsir kaynakları da ikincil nitelikte başvuru kaynağı olmuştur. Çalışma neticesinde üst düzey kamu görevlisinde bulunması gereken özellikler ilmi yetkinlik, emanet ve kudret olmak üzere üç temel başlık altında toplanmıştır. Temel başlıkların alt başlıklarına yer verilirken ahlaki niteliklerden ziyade somut ve maddi olarak tespiti mümkün olan hususlar zikredilmeye çalışılmıştır. Bahsedilen niteliklerin varlığıyla atamalarda kişisel menfaatlere göre hareket edilmesinin rüşvet, şefaat, intisap ve iltimas gibi gayri meşru yollarla kamu görevi tevcihinin engellenmesinin amaçlandığı görülmüştür.
The discretionary power granted to the head of state in the appointment of senior public administrators may be used against the public interest. Determining the qualifications that the appointees should have will prevent the abuse of the discretionary power of the head of state. This study aims to contribute to the solution of the aforementioned problem by trying to determine the qualifications that should be found in senior public administrators within the framework of works on Islamic public law and siyasetnames. In particular, the siyasetnames, which deal with the reasons for the collapse of states and the necessary reforms for their solution, have an important place in the study. As a result of the study, the qualities that should be present in a senior public administrator are discussed under three main headings: scientific competence, trust and power. While determining the sub-headings of the main headings, concrete and materially determinable issues were mentioned rather than moral qualities. It is seen that the existence of the mentioned qualities aims to prevent acting according to personal desires and preventing the delegation of public office through illegitimate means such as bribery, intercession, initiation and favoritism.
