Tabii veya beşeri sebeplere bağlı olarak meydana gelen afet olgusu, genellikle olumsuz anlam yüklenmek suretiyle can ve mal güvenliğini tehdit eden bir kavram olarak nitelendirilmektedir. Bu doğrultuda afet olgusu, çoğu halde risk kavramıyla bir arada değerlendirilmekte ve bu riskin en doğru biçimde ve zamanında bertaraf edilmesi için birtakım önlemlerin alınması gerekmektedir. Bu önlemlerin tekil olarak kişi nezdinde alınması mümkün olsa da geniş ölçekte planlı bir biçimde soruna yaklaşmak ve çözüm getirmek için idari makamların müdahalesi, önemli bir gerekliliği ifade etmektedir. Bunun yanında, alınacak önlemlere ek olarak afet olgusu meydana geldikten sonra ne yapılması gerektiği hususu da önemli bir aşamadır. Zira deprem gibi afet olgularının meydana gelmesi önlenemediğinden olası zararın meydana gelmesi durumunda bunun azaltılmasına ve giderimine yoğunlaşılması gerekmektedir. Bu doğrultuda, afet olgusu meydana geldikten sonra ortaya çıkan zararların giderimi, 7269 sayılı Kanun çerçevesinde hasar tespiti, hak sahipliği ve yardımların yapılması hususlarıyla açıklanacaktır. Bu nedenledir ki, afet riskinin önlenmesi yanında afet sonrasında yapılacak çalışmalar bakımından idari makamların aktif rol üstlenmesi söz konusudur. Çalışmada, idari makamların afet olgusundan ileri gelen zarar halini azaltmaya dair faaliyetlerinin kapsamı ile bu çerçevede yapılan hasar tespit işlemlerinin hukuki niteliği ve yargısal denetimi konuları irdelenecektir.
The phenomenon of disaster, which occurs due to natural or human causes, is generally characterized as a concept that threatens the safety of life and property by attributing a negative meaning. In this respect, disaster phenomenon is generally evaluated together with the concept of risk and some measures should be taken in order to eliminate this risk in the most accurate and timely manner. Although it is possible to take these measures individually, the intervention of administrative authorities is an important necessity in order to approach and solve the problem on a large scale and in a planned manner. In addition to the measures to be taken, the issue of what to do after the disaster occurs is also an important stage. Since the occurrence of disasters such as earthquakes cannot be prevented, it is necessary to focus on reducing and eliminating the negative effects in case of possible damage. In this regard, compensation for damages occurring after a disaster will be explained in terms of damage assessment, entitlement and assistance within the framework of Law No. 7269. For this reason, in addition to the prevention of disaster risk, administrative authorities have an active role in post-disaster activities. In this study, the scope of the activities of the administrative authorities to mitigate the damage caused by the disaster phenomenon, the legal nature and judicial review of the damage assessment procedures carried out within this framework will be examined.
