Hukukun sosyal hayata uyumunu sağlayan örf ve âdet usul kurallarının belirlenmesi ve fıkhî meselelere çözümler sunması noktasında başvurulması gereken sosyal normdur. Zira örf ve âdete dayanan hükümlerin kamu tarafından benimsenmesi ve uygulanması daha kolaydır. Şâfiî mezhebinde fıkhın temel kaynakları Kitap, sünnet, icmâ ve kıyastan ibaret olsa da hakkında bu kaynaklarda bilgi bulunmayan fıkhî meselelerde karine olarak örf ve âdetin dikkate alındığını gösteren fıkhî çözümler bulunmaktadır. Ancak mezhepte örf ve âdete büyük önem atfedildiği halde usul eserlerinde icmâ ve kıyas gibi müstakil bir delil olarak ele alınmamış ve fıkhın delilleri arasında yeri ve sınırları derli toplu bir şekilde belirlenmemiştir. Şâfiîler örf ve âdet hakkında bir metodoloji geliştirmemişler, ancak onları hem usulde hem fürûda aktif bir şekilde kullanmışlardır. Bu nedenle fıkhî meseleleri çözüme kavuşturmak açısından örf ve âdetin kaynak değeri ile ilgili Şâfiî usulcülerin görüşlerinin analiz edilmesi önem kazanmaktadır. Önemine binaen çalışmada Şâfiîler’in örf ve âdetin kaynak değeri ile ilgili görüşlerini konu edindik. Çalışma boyunca İmâm Şâfiî’den itibaren Şâfiî usulcü ve fakihlerin görüşlerini analiz edip detaylı bir şekilde inceledik. Böylece konuyla ilgili görüşleri analitik yöntemle değerlendirdik ve Şâfiîler’in konuyla ilgili görüşlerini belirledik. Şâfiî mezhebinde örfün kaynak değeri ile ilgili görüşleri konu edindiğimiz bu çalışmada “örf ve âdet”in mahiyeti ve kapsamını, fıkhî meselelerde kaynak gösterilmesi, klasik dönem Şâfiî fakihlerin konuyla ilgili görüşlerini ortaya koymayı, örf ve âdeti fıkhî meseleleri çözüme kavuşturmak bakımından incelemeyi ve Şâfiî mezhebinde örf ile âdeti teorik bir temele oturtmayı amaç edindik. Çalışmada fıkhın daha kolay bir şekilde uygulanabilmesi noktasında önemli bir rol oynayan örf ve âdetin Şâfiî mezhebinde karine olarak dikkate alındığı sonucuna vardık.
Customs and traditions, which ensure the harmony of law with social life, are the social norms that should be applied to determine the rules of procedure and to offer solutions to fiqh issues. Because it is easier for the public to adopt and implement the provisions based on custom and traditions. Although the main sources of fiqh in the Shafi'i sect consist of the Book, Sunnah, ijma and qiyas, there are fiqh solutions showing that customs and traditions are taken into account as a presumption in fiqh issues that are not informed in these sources. However, although great importance is attached to custom and tradation in the madhhab, it is not considered as an independent evidence like ijma and qiyas in their works, and its place and boundaries among the evidences of fiqh have not been determined in a neat way. The Shafiis did not develop a methodology about custom and tradition, but they actively used them both in the methodology and in the furû. For this reason, it is important to analyze the views of Shafi'i scholars regarding the source value of customs and traditions in order to resolve the fiqh issues. Due to its importance, we have discussed the views of Shafiis about the source value of customs and traditions. Throughout the study, we analyzed and examined the views of Shafii scholars and jurists (fâqihs) from Imam Shafii in detail. Thus, we evaluated the opinions on the subject with the analytical method and determined the views of the Shafiis on the subject. In this study, in which we focus on the views on the source value of custom in the Shafi'i sect, the nature and scope of "customs and tradition", reference in fiqh issues, revealing the views of the classical Shafi'i jurists on the subject, examining the custom and the tradition in terms of solving the jurisprudential issues and in the Shafi'i sect. We aimed to put the custom and tradition on a theoretical basis. In the study, we came to the conclusion that the customs and traditions, which play an important role in the easier application of fiqh, are considered as presumption in the Shafi'i sect.
