Fıkıh Usûlünde İmâm Şâfiî’nin nesh anlayışı çok tartışılan konular arasındadır. İmâm Şâfiî, "her hüküm ancak aynı seviyede delil ile nesh edilebilir" prensibine dayanan bu düşünce sistemini örneklerle desteklemiş ve farklı tartışmalara katkı sağlamıştır. Bu konuda onu haklı gösterenler olduğu gibi karşı görüş geliştirenler de bulunmaktadır. Ona karşı çıkanlar arasında ise takipçilerinin olması konuyu daha önemli kılmaktadır. Ancak, fıkıh usûlünde yaygın anlayışa göre Sünnetle Kur'an'ın her ikisinin de vahiy olduğu noktasında bir farklılık bulunmamaktadır. İki temel kaynak arasındaki farklılık, nazım yönündedir. Bu bağlamda, İmâm Şâfiî'nin perspektifine göre, bir denklikten bahsedilebilir. Örneğin, mütevâtir haber, bilgi değeri bakımından Kur'an gibi kesinlik taşımaktadır. Bu makale, İmâm Şâfiî'nin Kur'an'ın Sünnet'i ve Sünnet'in Kur'an'ı nesh etme konusundaki düşünce sistemi üzerine yapılan çalışmaları ele almaktadır. İlk dönem usul bilginlerinin eserleri ile İmâm Şâfiî'nin nesh görüşü incelenmiştir. Ayrıca, günümüzde yapılan çalışmalardan da yararlanılmıştır. Makale, İmâm Şâfiî'nin Kur'an'ın Sünnet'i ile Sünnetin Kur'an'ı nesh etme konusundaki düşünce sisteminin bütünsel olarak değerlendirilmesine odaklanmaktadır. Bu düşünce sisteminde ortaya çıkan problemler üzerine bir kanaat sunulmaya çalışılmıştır. Bu çalışma, İmâm Şâfiî'nin Kur'an'ın Sünneti ve Sünnetin Kur'an'ı nesh etmesi konusundaki argümanlarını ve bu argümanlara dayanak teşkil eden kaynakları detaylı bir şekilde incelemekte ve bu argümanları yeniden değerlendirmeyi amaçlamaktadır. Diğer mezheplere ait görüşleri de değerlendirerek, İmâm Şâfiî'nin nesh konusundaki perspektifini daha iyi anlamaya yönelik bir çaba içermektedir. Makale, İmâm Şâfiî'nin düşüncesini eleştiren unsurları da içermekte olup, Kur'an'ın Sünneti ve Sünnetin Kur'an'ı nesh etme konularına odaklanmış, neshin alt konularına detaylı bir şekilde girmemektedir. Bu çalışma, İmâm Şâfiî'nin nesh anlayışıyla ilgili literatüre katkı sağlamayı hedeflemektedir.
In the usul al-fiqh, Imām Shāfiʿī's understanding of naskh is among the most debated topics. Imam Shafi'i supported this system of thought, which is based on the principle that "every judgement can only be naskh with the same level of evidence", with examples and contributed to different debates. In this regard, there are those who justify him as well as those who develop opposing views. The fact that his followers were among those who opposed him makes the issue more important. However, according to the common understanding in the usul al-fiqh, there is no difference between the Sunnah and the Qur'an in the sense that both are revelation. The difference between the two main sources is in the direction of versification. In this context, according to Imam Shafi'i's perspective, an equivalence can be mentioned. For example, the trustworthy news is as certain as the Qur'an in terms of information value. This article deals with the studies on Imam Shafi'i's system of thought on the Sunnah of the Qur'an and the Sunnah's abrogation of the Qur'an. The works of the first period usul scholars and Imam Shafi'i's view of prohibition are analysed. In addition, contemporary studies have also been utilised. The article focuses on the holistic evaluation of Imam Shafi'i's system of thought about the Sunnah of the Qur'an and the Sunnah's abrogation of the Qur'an. An attempt has been made to present an opinion on the problems arising in this system of thought. This study analyses in detail Imam Shafi'i's arguments about the Sunnah of the Qur'an and the Sunnah's abrogation of the Qur'an and the sources on which these arguments are based and aims to re-evaluate these arguments. It also evaluates the views of other sects and endeavours to better understand Imam Shafi'i's perspective on the issue of prohibition. The article also includes elements that criticise Imam Shafi'i's thought and focuses on the issues of the Sunnah of the Qur'an and the Sunnah's abrogation of the Qur'an, and does not go into the sub-issues of prohibition in detail. This study aims to contribute to the literature on Imam Shafi'i's understanding of prohibition.
