Aile Hukuku, Türk Medeni Kanunu'nun ikinci kitabında düzenlenmiştir. Aile hukuku kitabının birinci kısmının ikinci bölümünde ise evlilik birliğini sona erdiren hallerden biri olan boşanma düzenlenmiştir (TMK m.161-TMK m.184). Öncelikle bu çalışmada, anlaşmalı boşanmanın tarihî gelişimi incelenmiştir. Sonrasında sırayla, genel olarak anlaşmalı boşanma kavramına, sebeplerine ve diğer genel sebeplerle mukayesesine değinilmiştir. Devamında ise Yargıtay kararları eşliğinde, anlaşmalı boşanmanın şartları sırasıyla ve somutlaştırılmaya çalışılarak incelenmiştir. Çalışmamızda, Türk Hukuku’nda anlaşmalı ayrılık müessesine yer verilip verilmediğine ilişkin açıklamalar da kısaca yer almıştır. Nihayetinde, anlaşmalı boşanmada usûl hukukuna ilişkin bazı problemler de ele alınarak incelenmiştir.
Many people in Turkey are for divorce by consent. It is a result of the applica-bility of the divorce by consent. Therefore, in this study, the conditions of the divorce by consent are examined. Family Law is a book of the Turkish Civil Code. In this book divorce is regulated as a type of termination of the unity of marriage (Art. 161 to 184 TCC. Firstly, in this study, the historical development of the divorce by consent is analyzed. Then, the concept of divorce by consent, its reasons and its comparison with other general reasons are mentioned. Sub-sequently, the conditions of the divorce by consent are also examined in the light of the decisions of the Turkish Court of Appeal. Finally, some problems related to procedural law about divorce by consent are also examined.
