Özellikle mağduru çocuk olan cinsel suçların oldukça ciddi bir toplumsal sorun olduğuna şüphe yoktur. Bu konuda medyaya yansıyan her olayda cinsel suç faillerine duyulan toplumsal tepki ve nefretin arttığı görülmekte; onlara (kimyasal) kastrasyon uygulanması önerilmektedir. Hukukçu ve siyasetçilere düşense, bu tür durumlarda soğukkanlı davranarak etkili ve ideal çözümü üretmektir. Ne var ki, gerek hukukçu ve siyasetçilerin bir kısmında, gerekse toplumda kimyasal kastrasyonun bu sorunu çözecek sihirli bir değnek olduğu inancı görülmektedir. Nitekim Türkiye’de konuyla ilgili yasal hazırlıklar yapıldığı bilinmektedir. Çalışmamızda bu yönteme ilişkin tıp ve özellikle psikiyatri biliminin verilerinin yanında, kriminolojik ampirik araştırma bulgularından yararlanılarak, yöntemin cinsel suç faillerine uygulanabilir olup olmadığı, hukukçu gözüyle değerlendirilmeye çalışılmaktadır. Ulaşılan bulgular cinsel suç faillerine uygulanan kimyasal kastrasyon dışındaki yöntemlerin başarı sağladığını göstermektedir. Kimyasal kastrasyonun ise düşünüldüğü gibi etkili ve tereddütsüz uygulanabilir bir yöntem olmadığı görülmektedir. Bunun yanı sıra, çok sayıdaki ciddi yan etkisi nedeniyle tartışmaya açıktır.
There is no doubt that sexual crimes, especially victims of which are children, is a very serious social problem. It is seen that the social reaction and hatred towards the perpetrators of sexual crimes increases in every incident reflected in the media on this issue; it is recommended to apply (chemical) castration to them. What falls to lawyers and politicians is to act calmly in such cases and produce an effective and ideal solution. However, some of the lawyers and politicians, as well as the society, believe that chemical castration is a magic wand that will solve this problem. As a matter of fact, it is known that legal preparations have been made on the subject in Turkey. In our study, in addition to the data related to this method of medicine and especially psychiatric sciences, the findings of criminal empirical research are used to evaluate whether the method is applicable to sexual crime actors, by the lawyer’s eye. The findings show that methods other than chemical castration applied to sexual crimes have achieved success. Chemical castration is not as effective and unquestionably applicable as it is thought. In addition, it is open to debate due to a large number of serious side effects.
