Abstract:

Violence against women is a phenomenon seen in all societies, which may be rooted in many political, economic, cultural and legal problems. For this reason, on the one hand, the need to combat the problem with both multi-actor and holistic view emerges, and on the other hand, when the causes and consequences of violence against women are subject to scientific research with the developed political struggle mechanisms, the need to address it with a multi-disciplinary approach arises. In this context, in the study, the introduction of the phenomenon of violence against women into international legislation was discussed together with the international agreements to which Turkey is a party, and the mechanisms to combat violence developed with the “Law on the Protection of the Family and Prevention of Violence Against Women” No. 6284 were examined within the framework of the Constitutional Court decisions. Thus, problems related to the implementation of the law can be addressed within the framework of violations of the right. Within the scope of the study, as of October 2023, “Law No. 6284” was selected and filtered from the relevant legislation section of the Constitutional Court Decisions Information Bank, thirty decisions were reached, and these decisions were examined with the documentary observation technique. The number of studies conducted within the framework of the Constitutional Court decisions on the subject is quite low. In this respect, it is thought that the study will contribute to the literature. In the study, only individual application decisions were examined, constitutionality review decisions were not included, and the study was prepared within the framework of current individual application decisions.
