Bu araştırmada Öğretmenlik Meslek Kanunu’na ilişkin okul yöneticisi ve öğretmenlerin görüşlerinin incelenmesi amaçlanmaktadır. Araştırma nitel araştırma yöntemlerinden fenomenoloji (olgu bilim) deseni kullanılarak yürütülmüştür. Bu araştırma kapsamında 2021-2022 eğitim öğretim yılında İstanbul ilinin çeşitli ilçelerinde görev yapan, farklı sendikalara bağlı veya hiçbir sendikaya üye olmayan 9’u kadın 16’sı erkek olmak üzere toplam 25 okul yöneticisi ve öğretmen ile görüşülmüştür. Araştırmanın katılımcıları amaçlı örnekleme yöntemlerinden kartopu örneklem yöntemiyle belirlenmiştir. Bu araştırmada verilerin toplanması yarı yapılandırılmış görüşme tekniği ile gerçekleştirilmiştir. Araştırmada yarı yapılandırılmış görüşme tekniği ile elde edilen verileri analiz etmek için içerik analizi kullanılmıştır. Araştırmada elde edilen sonuçlara göre okul yöneticisi ve öğretmenler tarafından Öğretmenlik Meslek Kanunu kapsamının dar olması, tüm öğretmenleri kapsamaması ve özlük haklar ile ilgili gerekli düzenlemelerin kanunda yer almaması bakımından beklentileri karşılamamış ve yetersiz bulunmuştur. Araştırma kapsamında Öğretmenlik Kariyer Basamakları Sınavı da sadece yazılı sınav olması bakımından gerçek bir ölçme sağlayamayacağı noktasında eleştirilmiştir. Öğretmenlik kariyer basamakları uygulaması bazı katılımcılar tarafından öğretmenleri ayrıştırıp rekabete soktuğu, ekip ruhunu ortadan kaldırdığı ve okul iklimini olumsuz etkilediği gerekçesiyle problem olarak görülmektedir. Öğretmenlik Meslek Kanunu’nun gerekli düzenlemeler yapılarak kapsamının beklentileri karşılayacak şekilde genişletilmesi ve öğretmenleri ilgilendiren tüm konulara öğretmenlerin de görüşleri alınarak kanun içinde yer verilmesiyle tam bir meslek kanunu oluşturulmasının gerektiği değerlendirilmiştir.
This study aims to examine the views of school managers and teachers on the teaching profession law. The research is carried out using phenomenology (event science) designs from the research methods. In the framework of this study, in the 2021-2022 educational year, a total of 25 school managers and teachers, including 9 women and 16 women, who are associated with different trade unions or are not members of any trade unions, were discussed in various districts of the province of Istanbul. The participants of the study were determined by the method of sample of the target sample. In this study, the collection of data was carried out using a semi-configured conversation technique. In the study, content analysis was used to analyze the data obtained using a semi-configured interview technique. According to the results obtained in the study, the school managers and teachers have not and have not been able to meet the expectations in terms of the narrow scope of the teaching profession law, not covering all teachers and the necessary regulations relating to property rights are not included in the law. In the framework of the research, the Teacher's Career Degree Exam is also criticized at the point that it cannot provide a real measurement in terms of being a written exam. The application of teaching career stages is seen as a problem by some participants because it separates teachers and puts them into competition, eliminates team spirit and affects the school climate negatively. The teaching profession law should be extended to meet the expectations by making the necessary arrangements and the teachers should be considered to create a full professional law with the opinion of teachers on all matters that concern teachers.
In this research, it is aimed to examine the opinions of school administrators and teachers regarding the Professional Teaching Law. The research was carried out using the phenomenology (phenomenology) design, one of the qualitative research methods. Within the scope of this research, a total of 25 school administrators and teachers working in various districts of Istanbul in the 2021-2022 academic year, affiliated with different unions or not members of any union, were interviewed. The participants of the research were determined by the snowball sampling method, which is one of the purposeful sampling methods. Data collection in this study was carried out by semi-structured interview technique. In the research, content analysis technique was used to analyze the data obtained. According to the results obtained in the research, the school administrators and teachers found that the scope of the Professional Teaching Law inadequate, did not cover all teachers, and the necessary regulations regarding personal rights were not included in the law, and it did not meet the expectations and was found insufficient. Within the scope of the research, the Teaching Career Stages Exam was also criticized for not providing a real measurement since it is only a written exam. It has been evaluated that the scope of the Professional Teaching Law should be expanded by making the necessary arrangements and a complete professional law should be established by including all the issues concerning teachers in the law.
