İspanya’nın demokratikleşme tecrübesini ve 1978 anayasa yapım sürecini anlayabilmek için toplumsal yapısını bilmek gerekmektedir. Bu sebeple çalışmada evvela İspanya’nın kısa tarihine yer verilecektir. İspanya’da Galiçya, Katalonya, Bask gibi güçlü toplulukların yanı sıra irili ufaklı birçok topluluk vardır. Bunların her biri kendi içinde kültürel birliğini sağlamıştır ve birçoğunun kendi dili vardır. Dolayısıyla İspanya’nın anayasal düzeniyle ilgili bir çalışma mutlaka kutuplaşmış toplumlardaki anayasal hareketlere ilişkin teorileri de ihtiva etmelidir. Bu tür toplumlar için makbul kabul edilen anayasa yapım modelleri perakendeci yöntem ve uzlaşmacı ya da çatışmacı yöntemlerdir. Perakendeci yöntem anayasa yapımında kesin çözümlerden kaçınarak mümkün olduğunca muğlak, çelişik ifadeler kullanmayı ifade eder. Muhtemel sorunlara ilişkin çözümleri yargı ve yasama organlarına bırakır. Diğer tarafta ise anayasaların uzun müzakereler sonucunda sağlanmış olan mutabakatlarla yapılması durumu uzlaşmacı; müzakere yapılmaksızın tek bir partinin ya da partiler bloğunun kendi anayasal tercihlerini toplumun geri kalanına dayatması durumu ise çatışmacı yöntem söz konusudur. Çalışmada bu yöntemler kısaca anlatıldıktan sonra İspanya tecrübesine yer verilecektir.
To understand the experience of the democratisation of Spain and the constitution making process of 1978, it is necessary to know Spain’s social structure. For this reason, this study will give a short history of Spain firstly in the study. There are substantial communities such as Galicia, Catalonia, and the Basque in Spain. Each of these has provided cultural unity, and many of them have their language. Therefore, a study of the constitutional order of Spain must include theories on constitutional movements in divided societies. The constitution-making models accepted as acceptable for such communities are the retail and conciliatory or confrontational methods. The retailer method refers to using vague and contradictory expressions as much as possible by avoiding definitive constitution-making solutions. Instead, it leaves solutions to potential problems to the judiciary and legislature. On the other hand, the case of making the constitutions with the agreements reached as a result of long negotiations is a conciliatory method. Finally, the aggressive method is in question when a single party or bloc of parties imposes its constitutional preferences on the rest of society without negotiation. After briefly explaining these methods, the study will include the Spanish experience.
