Engellilik, herhangi bir nedenle bireylerde fiziksel, ruhsal, zihinsel olarak bir yetersizliğin meydana gelmesi ve yetersizlikten etkilenen bireyin, yaşamının birçok alanında engellere maruz kalması olarak tanımlanabilir. Engellilik durumu bireyin, sağlık, eğitim ve adalet gibi kurumlarındaki temel haklarına yönelik hizmetlere eşit erişimini sınırlı kılmaktadır. Engelli bireylerin adalete erişimi sınırlı olduğu için engellilerin adalete erişim konusunda yaşadığı sorunların tespiti oldukça önemlidir. Türkiye’de engellilerin adalete eşit erişimi konusunda yapılan araştırmalar yok denecek kadar azdır. Dolayısıyla bu araştırmanın amacı, bedensel, görme ve işitme engelli bireylerin Van Adalet Sarayına eşit erişim durumlarının incelenmesi olarak belirlenmiştir. Araştırmanın çalışma grubu Van ilinin Tuşba, İpekyolu ve Edremit ilçelerinde yaşayan ve 2018 yılı içinde adalete erişim ihtiyacı doğan toplamda 15 engelli bireyden oluşmaktadır. Veriler yarı yapılandırılmış görüşmeler yoluyla katılımcılarla yüz yüze görüşme sonucu ve dört aylık süreçte elde edilmiştir. Katılımcılardan elde edilen veriler betimsel analize tabi tutularak sunulmuştur. Engelli bireylerin Van Adalet Sarayına eşit erişim konusunda dış mekânda güçlükler ile karşılaştıklarına, iç mekânda yeterli danışmanlık hizmeti almadıklarına, adalete eşit erişim konusunda ayrımcılığa maruz kaldıklarına ilişkin bulgulara ulaşılmıştır. Böylece, engelli bireylerin adalete eşit erişim haklarına erişebilirlik bağlamında yararlanamadıkları sonucuna ulaşılmıştır. Dolayısıyla, ileri araştırmalar için engelli bireylerin adalete erişimi konusunda Türkiye geneli yeni araştırmaların yapılması önerilmektedir.
Disability can be defined as the occurrence of a physical, mental, mental disability in individuals for any reason and the person affected by disability is exposed to disabilities in many areas of his life. The disability situation restricts the equal access of the individual to the services of his fundamental rights in his institutions such as health, education and justice. Because the access to justice for disabled persons is limited, it is very important to identify the problems with which disabled persons experience access to justice. In Turkey, research on equal access to justice for disabled persons is not enough to be done. Therefore, the purpose of this study is to study the conditions of equal access to the Van Justice Palace for physical, visual and hearing disabilities. The study’s work group consists of 15 disabled individuals living in the districts of Tuşba, Ipekyolu and Edremit in the province of Van, and in 2018 the need for access to justice was born. The data was obtained as a result of face-to-face conversations with participants through semi-configured conversations and in a four-month process. The data obtained from the participants was submitted under visual analysis. Disabled persons face difficulties in the outer space regarding equal access to the Van Justice Palace, not receiving adequate consultancy services in the interior, and have been discriminated on equal access to justice. Thus, the conclusion has been made that disabled persons cannot benefit from equal access to justice in the context of accessibility. Therefore, it is recommended that new research in Turkey is carried out on the access to justice of disabled persons for advanced research.
In international legal documents and national laws, the right of individuals to access justice in equal conditions, as well as many rights, are guaranteed. Thus, when individuals experience any negativity regarding their fundamental rights, legally determined fundamental rights come into play and their access to justice institutions becomes mandatory. Disability can be defined as the occurrence of a physical, mental and mental disability in individuals for any reason and the exposure of the individual affected by the disability to obstacles in many areas of her life. Disability restricts the individual's equal access to services for his / her fundamental rights in institutions such as health, education and justice. Since disabled people have limited access to justice, it is very important to identify the problems faced by disabled people in access to justice. No research conducted on equal access to justice for persons with disabilities in Turkey is almost negligible. Therefore, the purpose of this study was determined to examine the equal access status of physically, visually and hearing impaired individuals to the Van Court of Justice. The study group of the study consists of 15 disabled individuals living in Tusba, İpekyolu and Edremit districts of Van and were born in 2018 in need of access to justice. The data were obtained as a result of face-to-face interviews with the participants through semi-structured interviews over a four-month period. The data obtained from the participants were presented by descriptive analysis. It was found that the disabled individuals faced difficulties in equal access to the Van Court of Justice outdoors, did not receive adequate consultancy services indoors, and were exposed to discrimination regarding equal access to justice. Thus, it has been concluded that persons with disabilities cannot benefit from equal access to justice rights in terms of accessibility. Thus, in general the access to justice of persons with disabilities in Turkey for further research are suggested to new research.
