Amaç: Ülkemizde şehirlerarası yolcu taşımacılığında en çok otobüsler kullanılmaktadır. Genellikle orta ve büyük ölçekli şirketlerin yer aldığı otobüs taşımacılığı şeklinde bir sektör de oluşmuştur. Otobüsle yolcu taşıma sözleşmesinde, daha zayıf taraf konumunda bulunan yolcunun asgari seviyede de olsa korunması gerekmektedir. Otobüs taşımacılığı sektörünün gösterdiği özellikler dikkate alınarak, sektördeki şirketlerin hizmet kalitesi iyileştirilmeli ve yükseltilmelidir. Otobüs kazası sonucunda yaralanan veya vefat eden yolcular ilgili tazminat talepleri Avrupa Birliğine üye ülkelerin iç hukuklarında hali hazırda düzenlenmiştir. Ancak başta yolcuların sigorta edilmesi, engelli yolcuların hizmete erişimi, yolcuların seyahat öncesi ve sonrası bilgi alması, seferin gecikmesi ve iptali hallerinde yolcuların hakları ile yolcuların otobüs işletmeciliği yapan şirketleri şikâyet etmeleri ile şikâyetlerin makul sürede sonuçlandırılması için Avrupa Birliğince 16 Şubat 2011 tarihinde 181/2011 sayılı Tüzük çıkarılmıştır. Böylece AB üyesi ülkelerde otobüsle seyahat eden yolcularla ilgili yeknesak bir düzenleme oluşmuştur. Ülkemizde otobüsle seyahat eden yolcuların haklarına ilişkin özel bir düzenleme bulunmamaktadır. Kısmen Karayolu Taşıma Kanunu kısmen de Türk Ticaret Kanununda bir takım düzenlemeler bulunsa da, AB’ye uyum çerçevesinde bu konuda da özel düzenleme yapılması gerekmektedir. Olası Türk Yolcu Taşıma Kanunu ve buna ilişkin çıkarılacak Yönetmeliklerde AB’nin 181/2011 sayılı Tüzüğünün emsal alınması bakımından çalışmamız faydalı olacaktır. Yöntem: Çalışmamızda kaynak tarama yöntemi esas alınmıştır. AB’nin 181/2011 sayılı Tüzüğü çevrilmiştir. Bulgular: Türk hukukunda otobüsle seyahat eden yolcuların hakları özel olarak düzenlenmemiştir. Sonuç: Çalışmamızda AB’nin 181/2011 sayılı Tüzüğünde düzenlenen yolcu hakları incelenmiştir. Bu Tüzük esas alınarak otobüsle seyahat eden yolcuların hakları kanuni düzenlenmelidir.
The most popular buses in our country are transported by passengers. It has also formed a sector in the form of bus transportation where medium and large-scale companies are involved. In the passenger transport agreement by bus, the passenger in a weaker position must be protected even at the minimum level. Given the characteristics showed by the bus transport industry, the service quality of companies in the sector should be improved and improved. The demand for compensation for passengers injured or dead as a result of a bus crash has been prepared in accordance with the national law of the Member States. The European Union Regulation No. 181/2011 was adopted on 16 February 2011 to resolve complaints on the rights of passengers in cases of delay and cancellation of the flight, the insurance of passengers, access to the service of disabled passengers, the information of passengers before and after the journey, and the complaints on the rights of passengers in cases of delay and cancellation of the flight. Therefore, a regulation has been established for passengers travelling by bus in the EU Member States. There is no special regulation on the rights of passengers travelling by bus in our country. Although the Turkish Trade Act has a set of regulations in part on the Road Transport Act, it is necessary to make a special regulation on this issue in the framework of compliance with the EU. It will be useful for us to work with the possibility of the Turkish Passenger Transport Act and the Regulations to be adopted in connection with the EU Regulation No. 181/2011. Method: Our work is based on the source scan method. The EU Regulation No. 181/2011 was translated. The Turkish law does not specially regulate the rights of passengers travelling by bus. Our study examined the rights of passengers under EU Regulation No. 181/2011. The rights of passengers travelling by bus on the basis of this Regulation must be regulated by law.
