Dünyada genel olarak istihdamda uygulanan politikalar, aktif ve pasif istihdam politikaları olmak üzere ikiye ayrılmaktadır. Aktif istihdam politikaları temel olarak hem işsiz hem de çalışan bireylerin becerilerini, mesleki vasıflarını ve girişimciliklerini geliştirmeye dönük piyasa odaklı politikalar iken pasif istihdam politikaları işsizlik sigortası, sosyal yardım ve sosyal hizmet gibi piyasa dışı ve asgari bir gelir güvencesi sağlamaya dönük politikalardır. Benzer bir yaklaşım engelli bireylerin istihdamında da benimsenmiş olup, aktif istihdam politikalarına öncelik veren ülkelerde engellilerin çalışma hayatına katılımlarının daha yüksek olduğu görülmektedir. Aktif istihdam politikalarının düşük olduğu ülkelerde, engelli bireylere yönelik toplumda var olan yanlış inanışlar, işverenlerin önyargıları, engellilerin mesleki vasıf ve becerilerinin düşük olması gibi nedenlerin bunda etkili olduğu görülmektedir. Geçmişten günümüze tüm dünyada engelli istihdamında en yaygın şekilde kullanılan yöntem, zorunlu çalıştırma yükümlülüğünü ifade eden ve belli sayıda ya da oranda engelli istihdamını mecburi kılan “kota yöntemi” olmuştur. Kota yöntemi engellilerin iş yaşamına girmelerini kolaylaştıran bir pozitif ayrımcılık uygulamasıdır. Ülkemizde de 1970’lere uzanan tarihçesi ile engelli istihdamında kota/kota-ceza yöntemi bu alanda varlığını korumaktadır. Bununla birlikte, engelli istihdamında 2000’li yılların başından başlayarak kota yöntemi ile birlikte diğer bazı istihdam yöntemleri de uygulamada yerini almaya başlamıştır. Bu süreçte, bir yandan yeni tedbirlerle kamuda ve özel sektörde ücretli istihdam nitel ve nicel olarak güçlendirilmeye çalışılırken, bir yandan da kendi işini kurma, sübvanse edilen istihdam, korumalı istihdam ve destekli istihdam gibi diğer bazı yöntemler de bazen mevzuat düzenlemeleri bazen de projeler yoluyla alanda varlığını göstermeye başlamıştır. Bu çalışmada engelli istihdamında 1970’lerden günümüze politika, mevzuat ve uygulama düzeyinde atılan adımlar, elde edilen başarılar ve geliştirilmesi gereken alanlar adım adım ele alınacak ve gelecekte daha nitelikli bir istihdam için alınması gereken tedbirler irdelenmeye çalışılacaktır.
Global employment policies are divided into two: active and passive employment policies. Active employment policies are basically market-oriented policies aimed at developing both unemployed and working individuals’ skills, professional qualities and entrepreneurship, while passive employment policies are policies aimed at ensuring a non-market and minimum income assurance such as unemployment insurance, social assistance and social services. A similar approach has also been adopted in the employment of disabled persons, and it is seen that in countries that prioritize active employment policies, the participation of disabled persons in the work life is higher. In countries where active employment policies are low, misconceptions that exist in society towards disabled persons, employers’ predictions, disabled persons’ professional qualifications and skills are low. From the past to today, the method used in disabled employment throughout the world has been the "cotta method" that expresses the obligatory employment obligation and makes certain number or proportion of disabled employment mandatory. Kota method is a positive discrimination application that makes it easier for disabled people to enter the business life. In our country, with the history of the 1970s and disabled employment, the Kota/kota-ceza method preserves its existence in this area. However, from the beginning of the 2000s in disabled employment, some other employment methods, along with the Kota method, have also begun to take place in the application. In this process, on the one hand, new measures are attempted to strengthen the quality and quantity of paid employment in the public and private sector, and on the other hand, some other methods such as the establishment of their own business, the granted employment, the protected employment and the supported employment have sometimes begun to show its existence in the field by legislation and sometimes through projects. In this study, the steps taken at the policy, legislation and implementation level in disabled employment from the 1970s to the present day, the achieved achievements and areas to be developed will be discussed step by step and will be attempted to address the measures to be taken for more qualified employment in the future.
