Abstract:

Türk Çalışma Mevzuatına 4857 sayılı İş Kanunu ile dahil edilmiş olan geçici iş ilişkisi, 4857 sayılı İş Kanunu’nun 7. maddesinde düzenlenmektedir. İlgili hükme paralel olarak iş sağlığı ve güvenliği mevzuatında da geçici iş ilişkisi hakkında düzenlemeler yapılmıştır. Çalışmamızda, dayanağı 6331 sayılı İş Sağlığı ve Güvenliği Kanunu olan Geçici veya Belirli Süreli İşlerde İş Sağlığı veya Güvenliği Hakkında Yönetmelik (İSGY) ile düzenlenen ve geçici iş ilişkisi kuran işverenlere yönelik hüküm altına alınan maddeler tahlil edilecektir. Bu bağlamda, 6331 sayılı Kanunun geçici iş ilişkilerinde de uygulanması gerekli olan 16. maddesinde yer alan bilgilendirme yükümlülüğü gibi önem arz eden birtakım maddelerin yanı sıra İSGY’nin geçici iş ilişkisi kuran işverenlerin uymakla yükümlü olduğu ifade edilen ve özellikle Yönetmeliğin “Özel Hükümler” başlıklı Üçüncü Bölümünü oluşturan 10. ve 11. maddelerinde hüküm altına alınan geçici iş ilişkisinde bilgilendirme ve sorumluluk başlığı altında yer alan hükümler üzerinde durulacak ve konu yargı kararlarına da temas edilmek suretiyle değerlendirilecektir. Ayrıca, hukuki sorumluluğu olan işverenlerin özel yükümlülüklere uymaması veya aykırı hareket etmesi durumunda karşılaşabileceği hukuki ve cezai yaptırımlara da genel hatlarıyla değinilecektir.

Abstract:

The provisional employment relationship, which is included in the Turkish Labour Regulation with the Labour Act No. 4857, is regulated in Article 7 of the Labour Act No. 4857.
