Abstract:

5846 sayılı Fikir ve Sanat Eserleri Kanunu’nun 85. maddesi mektup, hatıra ve benzeri yazıların yayımlanmasına ilişkin birtakım kurallar getirmektedir. Böylece yazarın veya muhatabın gizli ve özel hayatlarına ilişkin bilgilerin korunması amaçlanmaktadır. Bu tür bilgileri içeren yazıların bir hukuka uygunluk nedeni olmaksızın yayımlanması kişilik hakkının ihlaline neden olur. Dolayısıyla hükmün ihlali halinde gizli veya özel hayat alanlarına saldırıda bulunulan kişiler kişilik hakkının ihlalinden doğan talepleri ileri sürebilir.

Abstract:

Article 85 of the Ideas and Art Works Act No. 5846 provides a number of rules concerning the publication of letters, memories and similar texts. Thus, it is intended to protect the information concerning the secret and private life of the author or interlocutor. The publication of texts containing such information without a reason for legal conformity causes a violation of personality rights. Thus, in case of violation of the ruling, persons who are attacked in the secret or private areas of life may submit claims arising from the violation of the personal rights.
