Günlük hayatta sıkça karşılaşılan ve de usûl kaynaklarının çoğunda semavî nitelikteki avârız arasında değerlendirilen “nisyan/unutma”, son dönemlerde ehliyeti daraltan veya tamamen ortadan kaldıran bir unsur olarak görülmekten daha ziyade dinî ve hukukî yükümlülükler bağlamında geçerli bir mazeret kabul edilip edilmemesi yönüyle ele alınmıştır. Hz. Peygamber'in, ‘ümmetin üzerinden hata, unutma ve zorla yaptırılan şeylerin kaldırıldığı veya Allah’ın bunları bağışladığı’ şeklindeki hadisin yorumundaki farklılıklar nisyanla ilgili hükümlerin teorik temeliyle ilgili tartışmalarda öncelikli bir yere sahiptir. Hata, nisyan ve ikrah altında yapılan fiillerde ümmetten kaldırılan veya bağışlanan unsur sadece uhrevî sorumluluk mu yoksa hem uhrevî hem de dünyevî sonucun mu kaldırıldığı konusu fukahâ arasında ihtilaflıdır. Unutmanın hükümlere etkisiyle ilgili ihtilaflar sadece zikredilen durumla sınırlı olmayıp her bir olayın kendi özelliği ve o konu hakkındaki başkaca deliller de dikkate alınarak farklı yaklaşımlar ortaya konulmak suretiyle çözüme kavuşturulmaya çalışılmıştır. Ayrıca unutmanın hükümlere etkisi, fakihlerin ibadetlerin şartlarına ve bu durumların edâ ehliyetine yansımasına bakış açılarına göre de farklı şekillerde tezahür edebilmektedir. Bunun yanı sıra genellikle Allah veya kul hakkıyla ilintili olup-olmamasına göre ele alınan nisyanın belirli şartlar dahilinde Allah hakkı kapsamında mazeret sayılabileceği fakat kul hakkını ilgilendiren meselelerde dünyevî hüküm açısından etkisinin olmayacağı görülmektedir. Günlük hayatta özellikle ibadetlerle ilgili belli başlı konularda unutma sıkça karşılaşılabilen bir durum olup bazen bir mezhepte bulunmayan çözüm veya çıkış yolu diğer bir mezhep ya da fakihin görüşünde bulunabilmektedir. Bu farklı görüşlerin (hükümlerin) usûli zemin ve delilleriyle birlikte bilinmesi insanlar için daha rahatlatıcı düzenlemeler ortaya çıkaracağı gibi, farklı içtihatlar sonucu ortaya çıkan hükümlerden özellikle de ihtiyaç durumlarında faydalanılmasına imkân sağlayacaktır.
Forgetting, which is frequently encountered in everyday life and considered among the immaterial flaws in most of the sources of fiqh, has been treated in terms of whether it is accepted as a valid excuse in the context of religious and legal obligations rather than being seen as a factor that narrows or completely eliminates the legal obligation. Disputes about the effect of forgetting on the provisions are not limited to the situation mentioned, but each case is tried to be resolved by taking different approaches by taking into account its own characteristics and other evidence about the subject. In addition, the effect of forgetting on the terms can manifest in different ways depending on the perspective of fiqh scientists on the conditions of worship and their reflection on the legal obligation. In addition, it is seen that the forgetting, which is generally dealt with whether it is related to the right of God or his servant, can be considered as an excuse within the scope of the right to God within certain conditions, but it will not have any effect on the matters concerning the right to the servant. In daily life, it is a common situation to forget about certain issues related to worship, and sometimes the solution or way out of a sect can be found in the opinion of another sect or figh scholar. Knowing these different views together with their methodological basis and evidence will create more comforting arrangements for people and will enable the provision of different views to be used especially in situations of need.
