Strengthening the foundation of national economic resilience through MSMEs is very important, especially after MSMEs are able to prove their adaptability during the COVID-19 pandemic. To encourage the further development of MSMEs, in addition to incentive assistance, the government must also provide assistance by facilitating legal protection of MSMEs, particularly through intellectual property law. This research explores the relationship between trade secret protection and the development of MSMEs in Indonesia in the context of the development of e-commerce in Indonesia and builds important points of legal reconstruction that needs to be carried out as part of the process of protecting MSME Trade Secrets. This study aims to examine the landscape of intellectual property law implementation in Indonesia, the relevance of intellectual property rights in the development of MSMEs and the national economy, and examine the legal lag and its impact on the protection of Trade Secrets for MSMEs. So, this research method uses normative legal research methods. This research shows that Trade Secrets as an important part of intellectual property that supports the development of MSMEs still use arrangements that seem old-fashioned and do not provide space for technical explanations in the regulations.
