16 Nisan 2017 tarihinde yapılan halkoylaması ile Türkiye, yüzyıldan fazladır uyguladığı parlamenter hükümet sistemi modelini terk ederek başkanlık modelinin bir yansıması olarak ifade edilebilecek olan Cumhurbaşkanlığı Hükümet Sistemine geçiş yapmıştır. Yeni hükümet sisteminde çift başlı yürütme yetkisi sona erdirilmiş ve Cumhurbaşkanı bizzat hem yürütmenin kendisi hem de devletin temsilcisi olmuştur. Bu sistemde kuvvetler ayrılığı prensibi ve erkler arasındaki dengeler yeniden ele alınmıştır. Özellikle yasama ve yürütme erkleri arasındaki dengeler yeni sisteme göre yeniden dizayn edilmiştir. Söz konusu değişiklikler paradigma değişikliği niteliğinde olup, derinlemesine bir incelemeyi ve literatürde tartışılmayı hak etmektedir. Bu bağlamda çalışmada öncelikle Cumhurbaşkanlığı Hükümet Sisteminin temel özellikleri ve getirdiği yenilikler ele alınmış ve bu yeniliklerin beraberinde getirdiği fırsatlar ve sorunlar tespit edilmeye çalışılmış, söz konusu fırsatların yönetim sistemine hız, esneklik ve rasyonalite katacağı sonucuna varılmıştır. Diğer yandan potansiyel sorun alanlarının ise sistemde ve uygulamada yapılacak olan revizyonlarla iyileştirilebileceği düşünülmektedir.
With its referendum on April 16, 2017, Turkey has passed to the Presidential Government System, which can be expressed as a reflection of the presidential model by leaving the model of the parliamentary government system it has been applied for more than a century. In the new government system, the dual-head execution authority has been terminated and the President has become both the execution himself and the representative of the state. In this system, the principle of the division of forces and the balance between men has been re-worked. Particularly, the balance between legislation and implementation clauses has been re-designed according to the new system. These changes are a paradigm change and deserve a thorough examination and discussion in literature. In this context, the study first addressed the basic characteristics of the Presidential Government System and the innovations it brings, and the opportunities and problems that these innovations bring together were tried to be identified, and the conclusion was that these opportunities would add speed, flexibility and rationality to the management system. On the other hand, it is believed that potential areas of problem can be improved by the revisions that will be carried out in the system and in the application.
As a result of the referendum held on 16 April 2017, Turkey has abandoned the parliamentary government system it had adopted for more than a century and switched to the Presidential Government System, which may be regarded as a reflection of the presidential model. In the new government system, the double-headed executive authority has been ended and the President has become both the executive authority as well as the representative of the state. In this system, the principle of separation of powers and the balance between the powers have been reconsidered. In particular, the balance between the legislative and executive powers has been re-established according to the new system. These amendments constitute a paradigm shift and deserve to be analysed in depth and discussed in the literature. In this context, this study has first analysed the main features and innovations of the Presidential Government System and tried to identify the opportunities and problems brought by these innovations, and concluded that these opportunities will render the government system speedy, flexible and rational. In addition, it is considered that potential problem areas may be improved through systemic and practical revisions.
