Makalenin konusu, patent konularının bağımlılığı hâlinde zorunlu lisanstır. Zorunlu lisans, yetkili makam tarafından üçüncü bir tarafa, patent sahibinin izni olmaksızın bir buluşu kullanma yetkisidir. Makalede öncelikle, zorunlu lisansın kanunî ve nazarî temelleri ile zorunlu lisansla ilgili mülga ve merî mevzuat incelenmiştir. Türk patent sisteminde, patent konularının bağımlılığı hâlinde zorunlu lisans verilmesi, Sınai Mülkiyet Kanunu'nun 131. maddesinde yer alan özel hükümlere tâbidir. Patent konularının bağımlılığı hâlinde zorunlu lisans verilmesi, sonraki tarihli buluşun, birinci buluşa nazaran önemli ölçüde ekonomik öneme sahip önemli bir teknik ilerleme içermesine bağlıdır. Nihayetinde, patent konularının bağımlılığı hâlinde zorunlu lisans verme süreci incelenmektedir. Bu bağlamda, çalışmanın son kısmında, zorunlu lisans talebi, yetkili ve görevli mahkeme ve zorunlu lisans kararına dair esaslar incelenmiştir.
The subject of this paper is compulsory licensing in case of dependency of patent issues. Compulsory licencing is a prerogative granted by a competent authority to a third party to use an invention without the assent of the patent holder. In this paper, firstly, the legal and theoretical bases of compulsory license and abrogated and positive legislation related to compulsory license are examined. Under the Turkish patent system, compulsory licenses for the dependent patents are governed by the specific provision of Article 131 of the Turkish Industrial Property Code. To grant a compulsory license in case of dependency of patent issues depends on that the second invention involves an important technical advance of considerable economic significance. Eventually, the process of granting a compulsory license in case of dependency of patent issues is examined. In this context, in the last part of the study, compulsory license request, competent court and principles of compulsory license decision are analyzed.
