Abstract:

With the emergence of the Internet and with its widespread use, electronic transactions began increasing day by day. Face to face contracts are gradually replaced by contracts which are concluded by way of using electronic communications. Instead of hand-writing signature, electronic signature is utilized. Thus, contracts, which are drawn up on paper, are replaced by electronic contracts. In this sense, traditional way of doing commerce is increasingly giving place to electronic commerce. In this context, it is obvious that legal norms, which are adopted for establishing traditional contracts and for fulfilling the obligations resulted therefrom, must be realigned with this new development. In other words, new legal rules should be adopted in order to determine how electronic contracts will be made and how obligations will be fulfilled. States, as well as the United Nations and the European Union, could not remain unconcerned with this new development. Thus, all of these organizations have been introducing new legal regulations concerning electronic contracts with a view to eliminating all possible barriers on electronic commerce and to uniform the practice
