Rekabetin Korunması Hakkında Kanunda özel hüküm yer almadığından dolayı Rekabet ihlallerinden kaynaklanan tazminat davalarında haksız fiil zamanaşımı uygulanmaktadır. Haksız fiillere ilişkin zamanaşımı sürelerinin nasıl uygulanacağı, idari para cezası gerektiren rekabet ihlallerinden kaynaklanan tazminat davalarında ceza zamanaşımının uygulanıp uygulanmayacağı, zamanaşımı süresinin başlangıcı, zamanaşımının durması ve kesilmesi sebepleri tartışılması gereken hususlardır. Özellikle Yargıtay’ın son yıllarda ceza zamanaşımını uygulamaya başlamış olması ve istikrarlı şekilde bu uygulamayı sürdürmesi konunun önemini artırmaktadır. Bu çalışmada rekabet ihlallerinde uygulanması gereken zamanaşımı süreleri ve buna ilişkin uygulama esasları ele alınmıştır.
Due to the fact that there are no special provisions in the Law on the Protection of Competition, tort statute of limitations is applied in compensation cases arising from competition violations. How to apply the statute of limitations for torts, whether to apply the criminal statute of limitations in compensation cases arising from competition violations requiring administrative fines, the beginning of the statute of limitations, the reasons for stopping and interrupting the statute of limitations are issues that should be discussed. In particular, the fact that the Supreme Court has started implementing the criminal statute of limitations in recent years and has been steadily maintaining this practice increases the importance of the issue. In this study, the limitation periods that should be applied in case of competition violations and the application principles related to this are discussed.
