7153 ve 7181 Sayılı Kanunlarla İmar Kanununda Yapılan Değişiklikler Üzerine Bir İnceleme

Abstract:

3194 sayılı İmar Kanunu 1985 yılında yürürlüğe girmiştir. Bu kanunda yürürlük tarihinden itibaren çok sayıda değişiklik yapılmıştır. Son yapılan iki değişiklik çalışmamızın konusunu oluşturmaktadır. 7153 ve 7181 sayılı Kanunlarla bu değişiklikler yapılmıştır. 7153 sayılı Kanunla imar planı tanımlarından bazıları değiştirilmiştir. Mekânsal Strateji Planı Kanuna yeni plan olarak eklenmiştir. Metruk binaların yıkım yolu açılmış ve bisiklet yolu zorunluluğu getirilmiştir. 7181 sayılı Kanun ile birlikte Tarım arazilerinin korunması amaçlanmıştır. İfraz ve tevhid konusunda düzenlemeler getirilmiştir. İmar uygulamasıyla ilgili önemli yenilikler düzenlenmiştir. Şehir içi arsaların otopark olarak kullanılması sağlanmıştır.

Abstract:

The Zoning Law No. 3194 was entered into force in 1985. Several amendments have been made about this law since the enforcement date. The last two amendments are the subject of this study. These amendments were made by Laws No. 7153 and 7181. By Law No. 7153, some of the definitions of zoning plans have been amended. The Spatial Strategy Plan is regulated as new type of plans. This Law enables to demolish of derelict buildings and also makes cycling paths compulsory. Law no. 7181 aims to protect agricultural land. By this Law, some regulations are made about the division and unification of plots. Significant regulations are made about parcelling. Also it’s provided that urban plots can be used as parking lots.
