Mediation is a method for settling commercial disputes in which parties of the dispute have the control over the settlement process and its result, request an impartial and independent third person or persons to guide them to settle their disputes amicably. As an alternative dispute resolution method, the usage of mediation is increasing for settling international and domestic commercial disputes. The United Nations Commission on International Trade Law commenced working to create an international framework on recognition and enforcement of international settlement agreements resulting from mediation for establishing an efficient legal framework which creates harmony on cross-border enforcement and considering that mediation is an alternative and effective way of amicably settling commercial disputes. As a result of these efforts, UN General Assembly adopted the UN Convention on International Settlement Agreements Resulting from Mediation on 20 December 2018, which is open for signature on 7 August 2019 in Singapore. In this paper, we examine and introduce the Convention’s preparatory work, scope and provisions as adopted by the UN.
