Ceza muhakemesinin, sanık ve fiil olmak üzere iki temel unsuru bulunmaktadır. Yargılamadaki bütün ispat faaliyeti de temelde suç sayılan fiilin işlenip işlenmediğine ve işlenmiş ise sanığın bu suçu işleyip işlenmediğine odaklanmaktadır.
