Çağdaş hukuk ve siyasetin en başta gelen konularından biri şüphesiz insan haklarıdır. İnsan haklarına saygı gösterilmesi talebi, çağımızın en yaygın ve etkili siyasi ahlak çağrısıdır. Teorik olduğu kadar pratik bir sorun olan insan hakları son yıllarda ulusal ve uluslararası gündemin baş sıralarına yerleşmiş bulunmaktadır. Sadece akademik literatürde ve insan hakları savunucularının bildiri ve açıklamalarında değil, bürokratik ya da politik kaynaklı resmi söylemlerde de bu konu çok daha fazla tartışmanın odağında yer almaktadır
