Abstract:

Nicos Poulantzas's work in the 1960s and 1970s has revived the materialist or Marxist interpretation of the state, revealing a complex and comprehensive assessment of the capitalist state that has never been seen before. As a result of his work in the fields of law, state and economic-politics, Poulantzas has made decisive findings about the many matters of law philosophy and sociology, general public law, and even the constitutional and administrative law, from the legal ideology to the authoritarian state form, from the state-economic relationship to the fascism and military strikes. Despite all this, it seems that Poulantzas was neglected in the work of public lawyers in Turkey. Especially in public law literature, the State theory in related studies is not much found in Poulantzas' thoughts. This article tries to reveal the main lines of Poulantzas' state theory, in order to contribute to the removal of the defect and to invite similar studies in public law.

Nicos Poulantzas's works in the 1960s and 70s have revived the materialist or Marxist interpretation of state and presented a complex and inclusive evaluation of capitalist state, which had not seen before. Through his endeavors regarding law, state and political economy, Poulantzas pointed out many significant issues concerning philosophy and sociology of law, general theory of state and even constitutional and administrative law: Rechtsstaat as the normal form of capitalist state, the question of how private and public law structure class relations, juridical ideology, authoritarian statism, state-economy nexus, fascism, military coups. Nothwithstanding, it seems that Poulantzas has been neglected by public law scholars in Turkey. Especially, Poulantzas’s ideas have not been given much place in studies relating to state theory within public law literature. This article aims to outline Poulantzas's theory of capitalist state to contribute to elimination of this deficiency/negligence and to invite similar studies into the field of public law.
