Türkiye’nin yönetim şeklinin parlamenter sistemden “Partili Cumhurbaşkanlığı” olarak da anılan başkanlık sistemine dönüştürülmesini içeren Anayasa değişikliğinin, TBMM’de kabul edilmesiyle birlikte, artık Türkiye ‘Cumhurbaşkanlığı Hükümeti Sistemi’ modeli ile tanışmış oldu. Model, demokratik sistemler arasında en çok Başkanlık sistemine yakın bir model olarak karşımıza çıkmakla beraber, bu hükümet modeli ile birlikte devletin yürütme şekli yeniden şekillendirildi. Bu çalışmada, bugüne kadar yapılan en kapsamlı Anayasa değişikliği olan 16 nisan 2017 tarihli değişikliğin, yürütme erkine etkisi, değişen yürütme yapısı, Parlamenter rejimdeki Bakanlar Kurulu’nun görev ve yetkileri, bu yetkilerin Cumhurbaşkanlığı Hükümeti Sistemi’nde Cumhurbaşkanı’na devri ile oluşan yeni yürütme sistemine ilişkin tarihsel ve yasal incelemeler, çeşitli boyutlarıyla yer alınmış, yürütme yetkisindeki bu köklü değişikliğin genel olarak yerinde olduğu kanaati ile çalışma tamamlanmıştır.
The Constitution amendment, which includes the conversion of the form of governance of Turkey from the parliamentary system to the presidential system, also referred to as "Partial Presidency", with the adoption in the TBMM, has now met with the model of the "Presidential Government System" of Turkey. While the model appeared to us as the most close model to the presidential system among democratic systems, this government model was re-formed along with the way the state was conducted. In this study, the most comprehensive constitutional amendment made to date on April 16, 2017, the effect of the implementation, the changing implementation structure, the tasks and powers of the Council of Ministers in the Parliamentary regime, the historical and legal examinations of the new implementation system formed by the transfer of these powers to the President in the Presidential Government System, included in various dimensions, the work was completed with the conclusion that this root change in the implementation powers is generally in place.
With the adoption of the constitutional amendment, which includes the transformation of Turkey's government from the parliamentary system to the presidential system, also known as the “Presidential Presidency”, Turkey has now met with the “Presidential Government System” model. Although the model is most close to the presidential system among democratic systems, the way the state is run has been reshaped with this government model. In this study, the effect of the amendment dated April 16, 2017, which is the most comprehensive constitutional amendment made to date, on the executive power, the changing executive structure, the duties and powers of the Council of Ministers in the Parliamentary Regime, the new executive formed by the transfer of these powers to the President in the Presidential Government System. The historical and legal studies on the system of law have been included in various dimensions, and the study has been completed with the opinion that this radical change in the executive power is generally appropriate.
