Abstract:

The departure of citizens of other countries where armed conflicts occur to the areas where conflicts are not party to the conflict and where the conflict is not occurring in the national area and their functions in the lines of the conflicting parties are based on the history of the wars. From this point of view, the "stranger warrior" phenomenon appears to us as a concept experienced in the historical process. In the armies of the state without a citizen, sometimes paid soldiers, sometimes individuals or groups who struggle are expressed as "foreign fighters" and are continuing with different motivations today. In armed conflict environments, armed conflict violated by this group leads to controversy within the framework of the rules of the armed conflict law who will be responsible. Due to the violations of these rules, the individual criminal responsibility of foreign fighters and the international responsibility of states using foreign fighters has been analyzed.
