6331 sayılı İş Sağlığı ve Güvenliği Kanunun 30.06.2012 tarih 28339 Sayılı Resmî Gazete'de yayımlanarak yürürlüğe girmesi ile birlikte, Türk çalışma hayatında yeni bir dönem başlamış oldu. Daha evvel 4857 sayılı İş Kanunu ve Yönetmelikler ile düzenlenen iş sağlığı ve güvenliği kavramı, dağınık yapısından kurtarılarak 6331 sayılı İş Sağlığı ve Güvenliği Kanunu ile mevzuat tek çatı altında toplanmıştır. Ayrıca 6331 ile mevcut kapsam da genişletilerek dışarıda tutulan kamu personelinin de dahil edilmesi ile birlikte işyerlerinde sağlık ve güvenlikler tüm çalışanlar bakımından korunması gereken bir kavram haline gelmiştir. Kapsamın genişlemesi, önleyici yaklaşımların benimsendiği 6331 ile işveren ve işveren vekillerinin de sorumluluk alanları daha da genişletilmiştir. İşveren ve işveren vekillerinin iş sağlığı ve güvenliğindeki tüm sorumlulukları risk değerlendirmesi ve iş birliği temelinden bir yaklaşımla yeniden düzenlenmiştir. Yeni yaklaşım ile işverenlerin çalışanları ile etkin koordinasyon ve iş birliğini sağlayarak, işyerinde, tazmin etmekten öte, önleme yaklaşımını benimseyen katılımlı ve bütüncül koruma sağlanması hedeflenmiştir. Çalışma kapsamında, işverenin iş sağlığı ve güvenliği mevzuatı çerçevesindeki tüm yükümlülükleri ayrıntılı şekilde incelenmiştir.

With the entry into force of the Law on Occupational Health and Safety No. 6331, published in the Official Gazette No. 28339 on 30.06.2012, a new period in the Turkish work life has begun. The concept of occupational health and safety, which was previously organized by the Work Law and Regulations No. 4857, was rescued from its distorted structure and collected under a single roof with the Law No. 6331 on occupational health and safety. In addition, with 6331 the existing scope has also been expanded and the inclusion of the public staff kept outside has become a concept that health and safety in their workplaces must be protected in terms of all employees. The extension of the scope, with the 6331 adopted preventive approaches, the responsibilities of the employer and the employer’s representatives have been further expanded. All responsibilities of employers and employers’ agents in the field of health and safety at work have been reorganized by a risk assessment and cooperation-based approach. The new approach is aimed at providing effective coordination and cooperation between employers and their employees, in the workplace, in addition to compensation, to provide participatory and comprehensive protection that adopts the prevention approach. In the framework of the work, the employer’s obligations under the work health and safety legislation have been thoroughly examined.

A new era has begun in Turkey working life with the enactment of Occupational Health and Safety Law No. 6331 published in Offical Journal with dated 30.06.2012 and numbered 28339. The concept of occupational health and safety, which was previously regulated by the Labor Law No. 4857 and Regulations, was freed from its dispersed structure and the Occupational Health and Safety Law No. 6331 was gathered under single roof. In addition, with the inclusion of excluded public servant, the current scope has been extended to 6331 and health and safety at workplaces have become a concept that must be protected for all employees. With the 6331 adoption of preventive approaches, the widening of the scope has extended the resposibility areas of employers and employers' respresentatives. All responsibilities of employers 'and employers' representatives in occupational health and safety have been rearranged on the basis of risk assessment and cooperation. With the new approach, it is aimed at providing effective coordination and cooperation with employers' employees and to provide participatory and holistic protection that adopts prevention approach rather than indemnify to employees. Within the scope of the study, the employer obligations within the framework of occupational health and safety legislation were examined in detail.
