Seçimlerin yenilenmesi yönündeki tasarruf parlamento kararı biçiminde olabileceği gibi kanun biçiminde de olabilir. Zira 1982 Anayasası döneminde her iki şekilde alındığına dair örnekler bulunmaktadır. Bununla beraber seçimlerin parlamento kararı şeklindeki bir tasarrufla gerçekleştirilmesi isabetli olandır. Çünkü seçimlerin yenilenmesi kararı parlamento kararıyla gerçekleştirildiğinde bu kararın Cumhurbaşkanına gönderilmesi gerekmediği gibi, karara karşı Anayasa Mahkemesine iptal istemiyle başvurulması da mümkün değildir. Böylece TBMM’nin aldığı seçim kararının geri gönderilmesi ve iptal edilmesi ihtimalleri ortadan kalkmış olur. 2017 yılına dek TBMM’nin seçim kararı alması için özel bir çoğunluk öngörülmemişti. Dolayısıyla seçim kararı Anayasanın 96 ıncı maddesinde dayanağı olan genel karar yeter sayısına uygun olarak alınabilmekteydi. Oysa değişiklikler sonrası TBMM’nin seçim kararı alması imkânsız denecek derecede zorlaştırılmıştır. Bunun sebebi seçimlerin yenilenmesi ya da tersi yöndeki adımların Cumhurbaşkanına odaklanmak istenmesidir. Lakin bunda isabet olduğunu ifade etmek zordur. Nedeni ise yürütmeyi tam güç merkezi yapmak ve bu yolla yasamayı tamamen silik bir pozisyona düşmeye mahkûm etmektir. Cumhurbaşkanının mensubu olduğu partinin parlamentoda çoğunluğu sağlayan parti olması hâlinde seçim kararının parlamento kararı veya şeklî kanun biçiminde alınması oldukça güçtür. Tersi durumda ise kanun biçimindeki bir tasarrufla seçimlerin yenilenmesi mümkün olup, seçim kararının alınmasındaki özel çoğunluk engeli aşılabilir. Ne var ki her iki hâl bakımından krizlere gebe olabilecek süreçler kaçınılmazdır. Tecrübe edilmesine ve krizlere yol açmasına fırsat verilmeksizin gerekli değişikliklerin yapılması en doğru tercih olacaktır.
Savings in the direction of the renewal of elections may be in the form of parliamentary decision as well as in the form of law. There are examples that Zira was taken in both ways during the 1982 Constitution period. However, it is appropriate to make elections in the form of a parliamentary decision. Because when the decision to renew elections is made by a parliamentary decision, as it is not necessary to send this decision to the President, it is not possible to appeal to the Constitutional Court with a request for cancellation of the decision. Thus, the possibility of the return and cancellation of the election decision taken by the TBMM has disappeared. Until 2017, there was no special majority for the TBMM to make an election decision. Therefore, the election decision could be taken in accordance with the general number of decisions based on Article 96 of the Constitution. However, after the changes, the decision of the TBMM to make the election was unlikely. This is due to the renewal of the elections or the reversal steps to focus on the President. It is hard to say that it is a hit. The reason, however, is to make the execution a full power center and thus condemn the law to fall into a completely dismantled position. If the party in which the president is a member is a party with a majority in parliament, it is quite difficult to make the election decision in the form of a parliamentary decision or a formal law. In the trial case, with a saving in the form of law, the elections can be renewed, and the special majority in the decision-making of the elections can overcome the barrier. However, the processes that may result in crises in both situations are inevitable. It will be the right choice to make the necessary changes without giving them the opportunity to experience and lead to crises.
