Fikir ve sanat eserleri genellikle bir ad altında umuma arz edilirler. Eserin adını belirleme yetkisi eser sahibine aittir. Eser sahibinin izni olmadıkça eser adında kısaltmalar, eklemeler veya bakaca değişiklikler yapılamaz. Eser adları, eser sahibinin hususiyetini taşıması halinde, eserin bütününden bağımsız olarak bir edebi eser gibi korunabilir. Eser sahibi, bu nitelikteki eser adlarını bağımsız bir hak konusu haline getirebilir ve bunlar üzerindeki hakların ihlali halinde FSEK m. 66 vd. düzenlenen talepleri ileri sürebilir. Eser adları, haksız rekabet hükümleri kapsamında da korunmaktadır. FSEK m. 83’e göre, bir eser adının karıştırılmaya neden olabilecek şekilde bir başka eserde kullanılması haksız rekabet teşkil eder. Ancak bir eser adının bu kapsamda korunabilmesi için ayırt edici nitelikte olması ve umumen kullanılan adlardan olmaması gerekir.
Ideas and works of art are often presented to the public under a name. The authority to determine the name of the work belongs to the owner of the work. Without the authorization of the owner of the work, the name of the work cannot be shortened, added or modified. The name of the work may be protected, independently of the whole of the work, as a literary work, if the owner carries the specificity of the work. The owner of the work may make the work names of this qualification an independent right subject and, in the event of violation of the rights on them, FSEK m. 66 etc. Requests can be submitted. The names of the works are also protected under unfair competition rules. According to FSEK m.83, the use of a work in another work in a way that may cause confusion is an unfair competition. However, a work name must be distinctive in order to be preserved in this scope and must not be from the names used by the public.
