So many results that aren't mine?

İnsan haklarının tartışıldığı hemen tüm metinlerde pozitif hukukun, doğal haklar anlayışına dayandığı kabul edilmektedir. Doğal haklar, insanların doğuştan sahip oldukları devredilemez haklardır. Pozitif hukuk ise, doğal hakların geçerli olduğu toplumlardaki anarşi ya da düzensizlik durumuna son verme iddiasındadır. Buna göre doğal haklara bir takım sınırlandırılmalar getirilecek ve insan eliyle yeni haklar oluşturulacaktır.  Böylece düzenli bir toplum oluşturulacaktır. Çalışmamızda görüşlerini incelediğimiz Jeremy Bentham doğal haklara karşı çıkmaktadır. Zira doğal hakları sınırlamak zordur. Bu sebeple pozitif hukukun temeli doğal haklar olmamalıdır. Bentham, insan hakları meselesinde önemli bir adım olan Fransız ihtilalinin de meseleyi tam olarak çözemediğini dile getirmektedir. Çalışmamızda Bentham’ın doğal haklara karşı çıkış nedenlerini ve yerine ikame etmeye çalıştığı ilkeler ele alınmaktadır.

Abstract:

In all the texts on which human rights are discussed, it is recognized that the positive law is based on the understanding of natural rights. Natural rights are the untransferable rights that people have from birth. The positive law claims to end anarchy or irregularity in societies where natural rights apply. In this way, a number of natural rights will be restricted and new rights will be created by the human hand.  This will create a regular society. Jeremy Bentham, whom we study his opinions in our study, is opposed to natural rights. It is difficult to limit natural rights. Therefore, the basis of positive law should not be natural rights. Bentham says that the French conflict, which is an important step in the issue of human rights, is not able to solve the issue in full. Our study discusses the reasons for Bentham’s opposition to natural rights and the principles that Bentham tries to retain.
