Çalışma, Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Anlaşması (CISG) kapsamında borçlu tarafın sözleşmeye aykırı davranışlarından doğacak tazminat yükümlülüğünden belirli koşullar altında kurtulma imkanını düzenleyen m. 79/I hükmünü ele almayı hedeflemektedir. CISG sisteminde kusursuz sorumluluk esas alınmakla birlikte, bazı şartlar altında tarafların sorumluluktan kurtulmalarına imkân tanınmaktadır. CISG m. 79/I ile tarafların kontrol alanı dışında kalan, sözleşmenin akdi esnasında öngörülmesi ve kaçınılması mümkün olmayan engellerin söz konusu olması durumunda sorumluluktan kurtulmak mümkün olabilmektedir. Bu kapsamda çalışmamızda CISG m. 79/I hükmüne göre sorumluluktan kurtulmanın esasları incelenecek ve bu hükmün uygulanmasında ortaya çıkabilecek sorunlar, ilgili yargı kararlarına da değinilerek ortaya konulmaya çalışılacaktır.
The study aims to address Article 79/I of the United Nations Convention on Contracts relating to International Sale of Goods (CISG), which provides for the possibility of the debtor to get rid of compensation obligation under certain conditions arising from the violation of the agreement. Although the CISG system is based on perfect liability, it is recognized that under certain conditions it is possible for the parties to get rid of liability. CISG m. 79/I may be able to get rid of liability in the event of obstacles that remain outside the control sphere of the parties, which cannot be predicted and avoided during the contract. We are working on this CISG m. According to Article 79/I, the principles of exemption of liability will be examined and the problems that may arise in the application of this provision will also be attempted to be revealed by reference to the relevant court decisions.
This study aims to examine the exemption from damages in case of contractual breach of the debtor under certain circumstances according to article 79/I of United Nations Convention on Contracts for the International Sale of Goods (CISG). CSIC is substantially based on strict liability. In certain conditions, nonetheless, the parties could be exempted from this liability. Under the scope of article 79/I of CISG, a party’s failure to perform is attributable to an impediment beyond the party’s control, and that could not have been reasonably foreseen and avoided, it is possible to exempt the party from liability. Within this scope, in our study, the principles of exemption from liability under article 79/I of CISG will be examined and the problems which may occur while applying this provision will be set forth considering related adjudications.
