Bireysel başvuru, anayasa yargısı içinde yer alan bir anayasal denetim şeklidir. Bireysel başvuru yolu olağanüstü, istisnai ve ikincil niteliktedir. Bireysel başvurunun konusunu kamu gücü tarafından ihlal edildiği iddia edilen temel hak ve özgürlükler oluşturmaktadır. Bireysel başvuru yolunun AİHM nezdinde etkili bir iç hukuk yolu olduğu söylenebilir. Nitekim bireysel başvuru yolunun kabul edilmesiyle AİHM’e giden dosya sayısı azalmıştır. Bireysel başvuru yolu ön inceleme, kabul edilebilirlik incelemesi ve esas hakkında inceleme şeklinde üç aşamadan oluşmaktadır. Bu aşamalarda verilen kararlar ise şunlardır: İdari ret kararı, kabul edilebilirlik kararı, kabul edilemezlik kararı, düşme kararı, ihlal kararı, pilot kararı, tedbir kararı, ret kararı.
The individual application is a form of constitutional review within the constitutional jurisdiction. The individual application is an exceptional, extraordinary and subsidiary procedure. The subject of the individual application is the fundamental rights and freedoms that are alleged to have been violated by public power. It can be said that the individual application remedy is an effective domestic remedy before the ECtHR. As a result, with the adoption of the individual application remedy, the number of files going to the ECtHR has decreased. The individual application procedure consists of three stages: preliminary examination, examination of admissibility and examination on the merits. The decisions made at these stages are as follows: Rejection of application on administrative grounds, decision of admissibility, decision of inadmissibility, decision of dismissal, decision of violation, pilot decision, decision for the measure, decision of rejection.
