Yakın anlamlar ifade eden hilâf ve ihtilâf kavramları, çoğu zaman birbirlerinin yerine de kullanılmıştır. Fıkhî meseleler üzerinde cereyân eden görüş ayrılıkları Hz. Peygamber döneminde ortaya çıkmaya başlamıştır. Ancak Hz. Peygamber’in hayatta oluşu ve sahabenin konuyu ona arz etmesi ciddi tartışmaların yaşanmasına engel olmuştur. Hulefâ-i raşidîn ve müctehid imamlar döneminde de fıkhî ihtilâfların neden olduğu tartışmaların dozunun düşük olduğu söylenebilir. Ancak özellikle mezhepleşme süreci ile zuhûr eden taklid ve taassup ruhu, fıkhî meseleler üzerinde ciddi tartışmaların meydana gelmesine zemin hazırlamıştır. Günümüze kadar varlığını devam ettirmiş olan ihtilâf, kuşkusuz kıyamete kadar da var olmaya devam edecektir. Bu çalışmada fıkhî konular üzerinde cereyan eden ihtilâfın tarihsel süreç içerisinde geçirdiği evreler örneklerle incelenmeye çalışılacaktır.
The concepts of dispute (khilaf) and controversy (controversy) which have similar meanings, are often used interchangeably. Differences in opinion on issues related to fiqh/jurisprudence started to appear during the period of the Prophet. However, the fact that the Prophet was alive and that the companions presented the subject to him directly, prevented serious problems. It can be said that the dose of discussions caused by legal conflicts during the period of the first four caliphs and mujtahid imams was relatively low. However, especially the imitation and fanaticism spirit that emerged with the sectarianization process, prepared the ground for serious discussions on fiqh issues. The controversy, which has remained until today, will undoubtedly continue to exist until the Doomsday. In this study, the stages of the dispute on fiqh issues in historical process will try to be examined with examples.
