Birçok uluslararası hukuk metninde yer alan üç aşamalı test, uluslararası hukukta eser sahibinin haklarının sınırlandırılması ile ilgili olarak öngörülmüş, hukuk güvenliğini sağlamaya yönelik bir denetim aracıdır. Çalışma kapsamında üç aşamalı testin ülkeler açısından uluslararası ve ulusal boyutlarda ifade ettiği anlam üzerinde durulacaktır. Ayrıca adil kullanım hakkı öğretisine ve bu öğretinin üç aşamalı test ile olan benzerlikleri ve farklılıklarına değinilecektir. Son olarak bu çalışmada fikir ve sanat eserleri hukuku kapsamında bir eser meydana getirmiş olan eser sahiplerinin eser üzerinde sahip oldukları hakların sınırlandırılmasına ilişkin üç aşamalı test olarak ifade edilen metot gereğince uyulması gereken her bir aşama ayrı ayrı inceleme konusu yapılacaktır.
