That foreigner’s work in another country is generally restricted by that country and in case foreigners carry out certain procedures, they will be given work permit. Work permit system for foreigners, which is disorganized in our country, has been sought to be recovered by Law No: 4817 passed in 2003. By way of the entry into force of this Law, the Ministry of Labor gives work permit, save for the exceptions. In particular, delays and difficulties experienced with regard to obtaining qualification licenses for the employment of technical staff needed for foreign direct investment have led to amendments of this Law. With the amendments in 2010, prior authorization system has been introduced for the ones who will be employed in professional services and the principle that no document of professional competence shall be required from the ones working at non-professional services has been set out. An application has been filed to the Constitutional Court with the claim for annulment of the amendments mentioned above. The Court has rejected the application on the grounds that the regulation is in accordance with the principles of the state of law and equality.
