Abstract:

In recent years, most of the countries have tendency to make arrangements in the concept of liberty-safety, in which the safety has priority. While doing that, they use public order, social unrest and terrorism as an excuse. The base of that tendency is the 11th September attack in the United States of America. In fact, this date is a crucial point for the dilemma between freedom and safety. The approaches emerged at the end of the 19th century, which made up rights and freedom of human as a principle, replace with regulations in safety. However, a period, in which safety has a leading role, has started since this date. In addition, rights and liberty has been sacrificed for the sake of safety. As a result, such an attitude cause to reduction in area of law in terms of democratic constitutional state. It has currently discussed in many countries that whether freedom or safety is a leading purpose The debates that are emerged from the dilemma of liberty-safety are continued in the area of constitutional basic rights and arrangements and safety. For that reason, regulations about safety are regarded not only from national but also from international law and human rights aspects.In that article, the given authority to law enforcement officers, the use of force authority, some arrangements of law, which is known as Domestic Safety Law, which created great discussions, are observed
