Her çocuk sağlıklı fizyolojik ve psikososyal gelişim için aileye ihtiyaç duymaktadır. Ancak bazı çocuklar sosyal risklere maruz kalması nedeniyle öz ana-babasının bakım ve gözetiminde büyüme olanağına sahip değildir. Korunma ihtiyacı olan çocuk olarak nitelendirilen bu dezavantajlı çocuklar, kurum bakım modeline alternatif olarak aile temelli sosyal hizmet modellerinden yararlandırılmaktadırlar. Aile temelli bakım modeli olan evlat edinme bir taraftan çocuğun sağlıklı ve işlevsel bir aile ortamına kavuşmasını sağlarken diğer taraftan da ailenin çocuk sahibi olma özlemini gidermektedir. Evlat edinme işlemi, çocuğun yüksek yararı gözetilerek sosyal hizmet ve hukuk alanının işbirliği ile yerine getirilen bir hizmettir. Evlat edinme süreci ise korunma ihtiyacı olan çocuk, biyolojik ana-baba ve evlat edinmek isteyen aile bileşeninde gerçekleşmektedir. Evlat edinme konusunda yapılan araştırmalarda biyolojik annenin çocuğunu terk etme ya da evlat edinilmesine rıza gösterme kararını nasıl verdiğiyle ilgili sürecin çok fazla ele alınmadığı görülmektedir. Bu çalışmada evlilik birliği dışında dünyaya gelmesi nedeniyle evlat edindirme hizmetinden yararlandırılan bir çocuğun biyolojik annesi tarafından geri alınmak istenmesi sürecinde yaşanan hukuki hak arama mücadelesinin evlat edinilen çocuk, biyolojik anne, evlat edinen aile boyutuyla değerlendirilmesi amaçlanmıştır. Bu amaç doğrultusunda yazarın sosyal hizmet uzmanı olarak görev yaptığı dönemde evlat edinme sürecini yürüttüğü bir aile üzerinden örnek olay çalışması tekniği kullanılarak değerlendirme yapılmıştır. Sonuç olarak evlat edinme sürecinde çocuğa ve evlat edinilen aileye yoğunlaşıldığı, biyolojik annenin psikososyal durumuna yönelik herhangi bir müdahalede bulunulmadığı ve hukuki açıdan hatalar yapıldığı anlaşılmıştır. Evlat edinmenin tüm bileşenlerini kapsayacak bütüncül bir müdahale modeli geliştirilmesinin önemi tartışılmıştır.
Every child needs a family for a healthy physiological and psychosocial development. However, some children do not have the opportunity to grow under the care and supervision of their parents because they are exposed to social risks. These disadvantaged children, qualified as children in need of protection, benefit from family-based social services models as an alternative to the institutional care model. The model of family-based care is the acquisition of a child, on the one hand, ensures the child to get to a healthy and functional family environment, while on the other hand, the family dismisses the desire to have a child. The process of acquiring a child is a service carried out with the cooperation of the social service and the field of law, monitoring the high benefit of the child. The process of adoption occurs in the child who needs protection, the biological parent and the family part who wants to acquire a child. Research on childbirth shows that the process on how the biological mother decides to leave the child or consent to the childbirth is not much discussed. This study aims to evaluate the legal rights struggle in the process of requesting the return by the biological mother of a child who has been benefited from the adoption service due to his birth outside of the marriage union by the boy of the child who has been adopted, the biological mother, the boy of the family who has been adopted. For this purpose, the author was assessed using the example case study technique through a family in which the childbirth process was carried out during the period in which he served as a social service specialist. As a result, it was understood that the child was focused on the child and the child-acquired family in the process of adoption, that there was no interference with the psychosocial state of the biological mother and that there were legal errors. The importance of developing a comprehensive intervention model that will cover all the components of childbirth has been discussed.
Adoption is an important social service model for children in need of protection to be developed in a healthy and functional family context. Considering the best interests of the child, adoption procedures carried out in cooperation with the field of social work and law, including three parties as child, biological parent, and family seeking adoption. Researches on adoption indicate that how the process of a birth mother make her decision on abandoning her child or on consenting adoption of her child has not been discussed well. Therefore, in this study, it was aimed to evaluate the process of a birth mother’s challenge to return her child who was adopted due to born outside the marriage, from the aspects of the adopted child, birth mother, and adoptive family. In this case study, which was designed by case study techniques of the qualitative research method, it is evaluated the efforts of a single mother who gave birth to her child under difficult conditions, was forced to leave her child with the fear of social exclusion and notoriety, and wanted to regain her child. The birth mother, who is the subject of the study, has started a legal process to take back her adopted child. The adoptive family, who learned the incident after the legal process begin, was shocked and did not want to return the child. As a result of the birth mother's struggle, the court decided that the child to stay with the adoptive family. From this case, it can be understood that mistakes were made legally in the process of adoption because the child and the adopted family were focused, but there was no intervention for the birth mother’s psychosocial situation. Based on this case, in terms of law and social work, the study pointed out and discussed issues to consider in the process of adoption, and presented suggestions.
