Ceza mahkemeleri ile hukuk mahkemelerinin kararlarının konuları birbirlerinden farklıdır. Öyle ki, ceza mahkemeleri suç olarak sınıflandırılan ve ceza yaptırımıyla karşılaşan fiillerle ilgilenirken, hukuk mahkemeleri -görev alanlarına giren diğer uyuşmazlıkların yanındatazminat sorumluluğuna yol açan haksız fiillerle meşgul olmaktadır. Böyle olunca da kural olarak hukuk hâkiminin ceza hâkiminin kararları karşısında bağımsız olduğu ve serbestçe hareket ederek kendi kararını verebileceği kabul edilmektedir. Bununla beraber bu prensibin bazı istisnaları da bulunmaktadır. Diğer bir deyişle bağımsızlığa dair herhalde mutlak katı bir uygulama bulunmamaktadır. Bu bağlamda çalışmanın amacı, hukuk hâkiminin ceza hukuku kural ve kararlarını ne ölçüde dikkate almak durumunda olduğunu tespit etmektir
The issues of criminal courts and judicial courts are different. Thus, the criminal courts are concerned with the facts that are classified as crime and faced with punishment, while the legal courts are concerned with the unjust facts that lead to liability for other disputes that enter the fields of duty. As a rule, it is recognized that the judge of law is independent of the judge’s decisions and can freely act and make his own decisions. However, there are some exceptions to this principle. In other words, there is no absolute strict practice of independence. The aim of the study in this context is to determine how much the judge must take into account the rules and decisions of the criminal law.
