In the scope of the Labor Law numbered 4857, no doubt that the most argued issue is the status of the mainemployer and the sub-employer body. This issue has distracted the courts and it seems that it will continue to do so since the law was accepted and came into effect in 2003. Because of increasing trend of the employment form and spreading especially in the public sector, the issue became continuously on the agenda. In this study, the evolution process of sub-employer system which is not a new form employment type, is evaluated in terms of the conditions and legal aspects of it in general terms
