Islamic law covering all spheres of human life has also established some general principles concerning the relation of man to an object and the nature of the proprietor constant on the object. Islamic lawyers have expressed opinions on the foundation, variety, acquisition and loss of property since the early periods on the basis of the general principles of the Qur'an and Sunnah, which is the fundamental source of Islamic law. Islamic lawyers have tried to base their property by zimmeh theory in general. Because of the general structure of the classical literatüre Islamic lawyers have expressed general opinion on ownership in the context of issues related to debts and property law. However, it can be seen that some Islamic lawyers have systematically dealt with the nature and classification of ownership. Recent studies have been made taking into account the classification of human legal systems. In this work, which deals with ownership and the foundation of property according to Islamic law, first of all will be given ownership. Then in a period that can be considered very early it will be mentioned how Islamic lawyers explain ownership in the way of zimmeh theory.
